Welcome to the BlockAura ecosystem, encompassing BlockAura Classic and BlockAura Eternity tokens on the Polygon blockchain and all associated platforms (the “Platform”). These Terms of Use (“Terms”) govern your access to and use of the Platform, including websites, applications, smart contracts, APIs, documentation, community forums, and other related services. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Acceptance of Terms

  1. By using the Platform, you affirm that you are at least the legal age of majority in your jurisdiction and have the right, authority, and capacity to enter into and comply with these Terms.
  2. If you access the Platform on behalf of an entity, you represent that you have the authority to bind that entity to these Terms, in which case “you” and “your” refer to that entity.
  3. These Terms constitute a binding legal agreement between you and the BlockAura community (“we”, “us”, “our”). There is no centralized corporate entity; community custodians act as collective stewards.

2. Modifications to Terms

  1. We reserve the right to modify, add, or remove provisions of these Terms at any time. Material changes require a community governance proposal and on-chain vote.
  2. Updated Terms will be published with a new Effective Date. Your continued use of the Platform after publication constitutes acceptance of the revised Terms.

3. Access and Use

  1. Platform Availability: Access to the Platform may be interrupted for maintenance, upgrades, or unforeseen events. We do not guarantee uninterrupted access.
  2. Account Registration: Specific services (e.g., community forums) may require account creation. You agree to provide accurate, current, and complete information during registration and to update it as necessary.
  3. Prohibited Conduct: You agree not to:
    • Use the Platform for unlawful purposes.
    • Transmit spam, malware, or malicious code.
    • Interfere with the security or integrity of the Platform.
    • Attempt to gain unauthorized access to any part of the Platform.
    • Reverse engineer or exploit smart contracts without governance consent.

4. Smart Contracts and Transactions

  1. At-Your-Own-Risk: All transactions executed through the Platform’s smart contracts are final and irreversible. You bear full responsibility for your actions and transaction parameters.
  2. Gas and Fees: You are responsible for all gas fees or transaction costs associated with using Polygon-based contracts or any integrated services.
  3. No Warranty on Code: Smart contracts are provided “as-is”. We make no warranty regarding their functionality, security, or fitness for purpose.

5. Content Ownership and License

  1. Your Content: You retain ownership of content you submit (e.g., forum posts, comments, code contributions) but grant the community a worldwide, royalty-free, transferable license to use, reproduce, adapt, distribute, and display your content.
  2. Community Content: Content contributed by others is licensed under applicable open-source or Creative Commons licenses. You agree to abide by those license terms when using community content.
  3. Feedback: Any suggestions, ideas, or feedback you provide become the community’s property without obligation or compensation to you.

6. Intellectual Property Rights

  1. Platform IP: All trademarks, logos, and materials owned by the BlockAura community are protected. Unauthorized use may result in enforcement actions.
  2. Third-Party IP: Components licensed under third-party terms must be used in accordance with those licenses.

7. Privacy Reference

Your use of the Platform is subject to the BlockAura Privacy Policy, which is incorporated by reference.

8. Disclaimers and No Warranty

  1. As-Is: The Platform and all materials are provided “as-is” with all faults. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement.
  2. No Professional Advice: Information provided does not constitute legal, financial, or tax advice.

9. Limitation of Liability

  1. To the fullest extent permitted by law, neither the BlockAura community nor any contributor shall be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.
  2. In jurisdictions that do not allow such exclusions, liability is limited to the greatest extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless the BlockAura community, custodians, contributors, and other Users from any claims, liabilities, damages, or expenses arising from your violation of these Terms or your infringement of any third-party rights.

11. Termination

  1. We may suspend or terminate your access to the Platform for violation of these Terms or for any other reason at our discretion.
  2. Upon termination, all licenses and rights granted to you under these Terms immediately cease.

12. Governing Law and Dispute Resolution

  1. These Terms are governed by the laws of the Emirate of Dubai, UAE, excluding conflict-of-law principles.
  2. Any dispute shall be resolved through binding arbitration under DIAC rules, conducted in English.
  3. You waive any right to a jury trial or class action.

13. Miscellaneous

  1. Severability: If any provision is invalid, the remainder remains in effect.
  2. Entire Agreement: These Terms, together with the Privacy Policy and any other referenced documents, constitute the entire agreement between you and the BlockAura community regarding the Platform.
